What Are My Options For Becoming a Lawful Permanent Resident of the U.S.?
To become a Lawful Permanent Resident of the United States of America, you will need to obtain what is known as a Green Card. There are several different ways to qualify for this immigration status through our system of citizenship and immigration services. One way is to have an employer sponsor you for permanent residency under one of the many employment-based visa options also known as business immigration (or employment based immigration).
Another way is family immigration (or family based immigration), which is to have a family member who is a U.S. citizen sponsor you or to marry a citizen. You may also apply for a visa based on being a victim of a crime or through some other humanitarian relief. Other ways to get a Green Card are to make a large investment in a U.S. business or enter the Department of State’s Diversity Immigrant Visa Program lottery.
There are other special categories of visas that might be available to you, depending on your particular situation and legal status.
What Rights Will I Have as a Green Card Holder?
Once an immigrant has achieved Lawful Permanent Resident Status, you are covered by all of the laws of the United States and state and local jurisdictions. Your rights include the freedom of speech, freedom of religion, and equal protection and representation under the law, among others.
You may not vote in U.S. elections, however. You may work at any job that is legal and for which you are qualified, in any location, as long as the job is not one of the small number of government jobs that require citizenship.
You may move about the country freely and are eligible for certain benefits, such as health and education. International travel is also allowed, as long as your time outside the United States does not exceed 6 months and your intention to live in the U.S. permanently is clear. You may also petition for foreign-born family members to receive their own Green Cards, though there may be a wait for visas to become available for them.
What Will Be My Responsibilities as a Lawful Permanent Resident of the United States?
Once you have obtained Green Card status, you must abide by all laws of the country, state, and locality. You must report all income to the Internal Revenue Service through tax filing and pay any taxes that you owe. Although military service is not compulsory at this time, you will be required to register with the Selective Service if you are a male aged 18 through 25.
There is also the expectation that you will support the United States’ democratic form of government, though that does not include voting. If you leave the country, you must not stay away long enough that it seems you do not intend to live permanently in the United States. Call Sessoms Law Group, LLC today at 678-853-7402 to get started on your path to permanent residency.
